Is this mandatory under the Public Liability Insurance Act, 1991?
The PLI Act (1991) is a mandatory “No-Fault” policy for businesses handling hazardous substances in India. However, it has very low compensation limits (e.g., ₹25,000 for death). Environmental Liability Insurance is a voluntary policy that provides much higher, realistic coverage (into the Crores) for actual clean-up and legal defense.
Does it cover "Gradual Pollution" like a slow leak into the soil?
Yes. This is the primary reason to buy this policy. Most “Public Liability” policies in India only cover “Fortuitous” (sudden) events. Environmental Insurance covers pollution that happens slowly over months or years, which is often much more expensive to clean up.
What are "Clean-up Costs" in the Indian context?
If the State Pollution Control Board (SPCB) orders you to remove contaminated soil or treat polluted groundwater, those costs are covered. It also covers “Third-Party Clean-up” if your pollution migrates to a neighbor’s land or a local water body.
Does it cover "Legacy Pollution" from the previous owner?

No. In India, insurance cannot pay for fines or penalties imposed by a regulator (like the National Green Tribunal) for non-compliance with environmental laws. It only covers remediation costs and civil damages.

If a pollution event forces you to shut down your factory for weeks for cleaning, this policy can cover your loss of profits and fixed costs during that period, ensuring your business survives the downtime.
Is "Restoration of Biodiversity" covered?
Modern Indian policies are beginning to cover the costs of restoring a “natural resource” (like a local pond or forest area) to its original state if your business caused the damage.
Does it cover pollution during transportation?
