Is this policy mandatory by law in India?
It is mandatory under the Public Liability Insurance Act, 1991 for any business handling “Hazardous Substances” (like chemical plants or gas godowns). For others, like shops or offices, it is optional but often required by mall managements or commercial landlords in India.
Does it cover a guest tripping in my office lobby?
Yes. If a visitor is injured due to your negligence (like a loose carpet or slippery floor), the policy covers their medical expenses and any legal compensation you are ordered to pay by an Indian court.
Does it cover "Food Poisoning" at my restaurant?
Not by default. You must specifically add the “Food & Beverages Extension.” This is vital for Indian eateries, as it covers liability arising from contaminated food or drinks served on your premises.
What if my business causes a fire that spreads to the shop next door?
This is one of the most common claims in India. If a fire starts in your shop and damages a neighbour’s property, your Public Liability policy covers the Third-Party Property Damage (TPPD) claims filed against you.
Does it cover accidents in the building's lift?
Standard policies usually exclude lifts. However, you can add a “Lift Liability” extension which is highly recommended for office complexes and hotels in Indian cities.
Are my employees covered under this policy?
No. Public Liability only covers “Third Parties”. For your staff, you must take a Workmen’s Compensation (WC) policy as per the Employee’s Compensation Act.
Does it cover "Act of God" (AOG) events?
In India, you should always ensure your policy includes an AOG Extension. This covers your liability if a natural disaster (like the Mumbai floods or a Delhi earthquake) causes your building structure to collapse and injure someone outside.
